By accessing or using any part of this Site, you agree to each of the terms and conditions set forth herein (“Terms of Use”).

IN-Seattle reserves the right to modify the Terms of Use at any time without giving you prior notice. This Site and its content, including without limitation its trade marks, logos, design, text and graphics, is owned by and remains the property of IN-Seattle (except for contributions submitted by users of this site, which remain the property of the users). We may also include third party copyright materials and trade marks from time to time, which remain the property of their respective owners. Nothing in these terms of use or on this Site shall be construed as conferring on you any license or right to use any trade mark, copyright or other right of IN-Seattle or any third party.

4. Use of this Site
You may not use any part of this Site, or any materials or content on this Site, for personal gain or for any commercial purpose. No photograph, video and/or audio files or clips may be downloaded, reproduced or otherwise used without the express written consent of IN-Seattle. In the event we have clearly indicated that you may download materials from this Site, you may only do so for the use and purpose as indicated to raise awareness or promotion of IN-Seattle. You may not copy, transmit, store or disseminate any element of this Site, unless we have clearly indicated that you may do so. You may not alter, modify, adapt, reverse engineer, disassemble or create derivative works of any software contained on this Site. You may not collect or use any personal details from this Site. IN-Seattle reserves the right at its sole discretion to discontinue any aspect of this Site at any time.

5. Contributions to this Site
If you submit any contributions to this Site or to IN-Seattle including but not limited to photographs, video and/or audio clips/files, comments, posts or any other content, you hereby grant IN-Seattle the option to use the material in your contribution in all media. Such option includes the right to copy, edit, publish, and exercise all other copyright and publicity rights over the material. If you do not wish to grant these rights, please do not submit the material.
You warrant and represent that the contributions you submit are original and that you have all the necessary rights to submit the contributions. You agree not to submit any contributions which infringe any person’s intellectual property rights, including but not limited to any copyright or trade mark rights.

IN-Seattle does not endorse any contribution made by members of this Site, or any opinion, statement, or advice expressed in any contribution. To the fullest extent permitted by law, IN-Seattle expressly disclaims all liability in connection with any contribution made by a member of this Site. IN-Seattle reserves the right to remove any contribution without notice in the event that it is notified that the contribution infringes any person’s or entity’s intellectual property rights.
You should understand that your contributions may be accessible by and made public through syndication programs (including data feed tools) and by search engines, metasearch tools, crawlers, metacrawlers and other similar programs.

Additionally, in consideration of your use of our site, you agree that your contributions:
(a) shall not be fraudulent;
(b) shall not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
(c) shall not violate any law, statute, ordinance or regulation;
(d) shall not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
(e) shall not be obscene or contain, pornography, child pornography, or photographs of unclothed person(s);
(f) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
(g) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
(h) shall not link directly or indirectly to any materials to which you do not have a right to link to or include.

6. Unlawful and improper use
You may only use this Site for lawful purposes and you may not inhibit any person’s use or enjoyment of this Site. You agree to abide by all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of this Site. You may not submit, publish, post, distribute or transmit any defamatory, offensive, infringing, obscene, indecent or otherwise unlawful or objectionable material or information on this site.
If IN-Seattle considers, at its sole discretion, that you have breached these terms of use or demonstrated unlawful or inappropriate conduct in your use of this Site, we reserve the right to do the following without prior notice:
1) Warn you via email and require you to discontinue such conduct;
2) Delete any material which you have posted to this site;
3) Close your account/registration with this Site or any related service provided to you;
4) Terminate/Cancel your IN-Seattle membership and eliminate right of access to and use of the Site; and
5) Take any other lawful measure to prohibit such conduct.

7. User Conduct
We respect other people’s rights and we expect you to do the same. You are solely responsible for your interactions with other members of the Site.
As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by IN-Seattle.
By way of example, and not as a limitation, you agree not to use the Services:
(i) to abuse, harass, threaten, impersonate or intimidate other IN-Seattle users;
(ii) to post or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party, or content that contains homophobia, ethnic slurs or religious intolerance;
(iii) for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
(iv) to post or transmit any communication or solicitation designed or intended to obtain password, account, or private information from any IN-Seattle user;
(v) to create or submit unwanted email (“Spam”) to any other IN-Seattle users or any URL;
(vi) to violate any laws in your jurisdiction (including but not limited to copyright laws);
(vii) to submit stories or comments linking to multi-level marketing schemes;
(viii) attempt to impersonate an IN-Seattle Board Member, another member or any other person though any means;
(ix) sell or otherwise transfer your profile.

IN-Seattle may remove any content and IN-Seattle accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such content), or for no reason at all. 8. Membership Registration and Passwords
If you join IN-Seattle as a Member and create an account to access any part of this Site, you agree to the following:
• To keep your password secure and confidential and not to allow another person to use your details or password to access your account or any part of this Site,
• To notify IN-Seattle immediately if you become aware of any improper or unauthorized use of this Site or of any of your details or password;
• Never allow a non-member from gaining access to any password-protected area of this site;
• Never create additional membership accounts for the purpose of abusing any person or the functionality of this site,
• Never use another member’s account or details or seek to impersonate a different member, and
• Never use as your IN-Seattle Member ID a name that is otherwise offensive, vulgar or obscene.
• That you are solely responsible for all contributions you make and all activities you conduct on the Site.

In addition, you agree that you will provide us with your valid, current email address, both at the time of your member registration with us and from time to time as your email address changes.
We reserve the right to refuse registration of, or cancel an IN-Seattle Member ID at our discretion; if you select a User ID for your account we reserve the right to remove or reclaim it if we believe it infringes upon another’s rights or marks.

9. Sponsorship/Donations
All donations, sponsorship, and pledges made in support of IN-Seattle are non-refundable.

10. Disclaimer of Liability and Damages
You agree that IN-Seattle and its officers, trustees, employees and agents shall not be liable or responsible for any claim, loss, damage, costs and expenses of any nature (including but not limited to any direct, indirect, incidental, special, punitive, or consequential damages whether resulting from breach of contract, negligence or any other cause of action) arising in connection with this Site or your use of the Site, including but not limited to any contributions to this Site by members for any viruses, bugs, trojan horses or other contamination resulting from use of this Site, for any interruption or delays to the use of this Site, for any errors, omissions or inaccuracies in any materials on this Site.
You agree that you are solely responsible for your use of this Site, and that to the fullest extent permitted by law, IN-Seattle and its officers, trustees, employees and agents in connection with the Site and your use thereof do not make any representations and do not give any warranties, express or implied, concerning this Site; including, but not limited to any content or materials on this Site, and any other websites linked to or from this Site, and in particular does not warrant or represent that this Site or its contents are virus free.
You agree that all software provided by third parties (such as Acrobat Reader and RealPlayer) is the sole responsibility of that third party. IN-Seattle is not responsible for the content of any third party websites linked to or from this Site. Nothing in these terms of use shall exclude or limit any liability for death or personal injury arising from negligence, or for any other liability which cannot be excluded or limited by law.

11. IN-Seattle Privacy Policy

12. Indemnity
As a condition of use of this Site you agree to indemnify and hold harmless IN-Seattle and its officers, trustees, employees and agents from any and all liability, expenses (including attorney’s fees) and damages arising out of claims resulting from your use of the Site, or including without limitation any claims alleging facts that are true would constitute a breach by you of these terms and conditions.

13. Governing Law
These terms of use shall be governed by the laws of the Washington State. You consent to the exclusive jurisdiction and venue of courts in Washington State in all disputes arising out of or relating to the use of this Site.

If any provision of these terms of use is deemed to be invalid by a court of competent jurisdiction, such shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Any failure or delay by IN-Seattle in asserting any of its rights or of any provision of these terms of use shall not constitute a waiver of such right or provision.

We reserve the right at any time or times to modify or discontinue, temporarily or permanently, all or any portion of our site with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or termination of our site.
